Harrisburg man waives hearing on drug charges

A Harrisburg man found with cocaine and marijuana following a traffic stop waived his right to a preliminary hearing before Magisterial District Judge Patrick Ford.
Kyle G. McLean is charged with knowing or intentional manufacture, distribution, possession with intent to distribute, or possession of a designer drug; knowingly or intentionally possessing a controlled or counterfeit substance by person not registered; manufacture, delivery, or possession with intent to manufacture or deliver a controlled substance; possession of a small amount of marijuana with the intent to distribute; possession of a small amount of marijuana for personal use; use of, or possession with intent to use, drug paraphernalia.
According to the affidavit of probable cause, on Nov. 23 at 9:38 p.m. state trooper Brian Elensky of the Clearfield Barracks was traveling east on River Road in Lawrence Township when he began following a vehicle traveling 50 mph in a 35 mph zone and initiated a traffic stop.
Upon speaking to the driver, Elensky said there was a strong smell of marijuana coming from inside of the vehicle. There was a male driver and two male passengers inside of the vehicle.
The driver admitted to smoking marijuana earlier in the day. A field sobriety test was initiated and the driver was arrested for driving under the influence.
The driver also gave consent to search the vehicle. During the search police found 2.5 grams of cocaine a bag with 44.7 grams of marijuana, another bag with 55.6 grams of marijuana and a third bag with 75 MDMA (Ecstasy) pills inside a bag in the truck.
Police interviewed all three occupants and McLean confessed that he was the owner of the substances. The other two said they had no knowledge of them.
McLean is incarcerated at the Clearfield County Jail in lieu of $20,000 straight bail.
