Scott pleads in federal court Friday, December 07, 2012 JOHNSTOWN - A resident of West Decatur pleaded guilty in federal court to a charge of possession of child pornography, according to U.S. Attorney David J. Hickton. James L. Scott, 38, of 38 Spur Lane, West Decatur, pleaded guilty to one count before U.S. District Judge Kim R. Gibson. In connection with the guilty plea, the court was advised that on April 10, 2009, Scott knowingly possessed pictures and videos in individual computer graphic files, which were produced using minors engaging in sexually explicit conduct. The computer graphic files were shipped or transported in interstate or foreign commerce. Gibson scheduled sentencing for April 10, 2013, at 10:30 a.m. The law provides for a total sentence of 10 years in prison, a fine of $250,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based upon the seriousness of the offense and the criminal history, if any, of the defendant. Pending sentencing, the court continued Scott on bond. The Bureau of Immigration and Customs Enforcement conduced the investigation that led to the prosecution of Scott.
